This paper reflects on the problem of endowing Artificial Intelligence with legal subjectivity, especially with regard to civil law. It is necessary to reject the myth that the criteria of legal subjectivity are sentience and reason. Arguing that AI may have potential legal subjectivity based on an analogy to animals or juristic persons suggests the existence of a single hierarchy or sequence of entities, organized according to their degree of similarity to human beings; also, that the place of an entity (...) in this hierarchy determines the scope of subjectivity attributed to it. Rather, it is participation or presence in social life, whatever the role, that is the true criterion of subjectivity. In addition, it is clear that even if AI is not currently a significant participant in social life, it will be in the nearest future. Despite the potential dangers associated with endowing AI with some kind of subjectivity, such a course is inescapable, and should be considered sooner rather than later. (shrink)

The subject of agnosticism about the existence of God has emerged in many of the major conversations within analytic philosophy of religion, such as the debate on the nature of evidence for and against religious beliefs. In this article, I outline a map of the debate on agnosticism in religious epistemology—especially in relation to evidentialism—highlighting the significance of the problem of the ambiguity of evidence and connecting said problem to discussions of religious language and peer disagreement.

The sharing economy as an emerging field is characterized by unsettled debates about its shared purpose and defining characteristics of the organizations within this field. This study draws on neo-institutional theory to explore how sharing organizations position themselves vis-à-vis such debates with regard to (1) the values these organizations publicly promote to present themselves as “good” sharing organizations and (2) the business model features they make visible to appear as having the “right” organizational model. This study examines the online self-representations (...) of 62 prototypical sharing organizations in Germany with regard to value propositions and business model features. A semantic network analysis of the features reveals two distinct categories of sharing organizations: grassroots initiatives and platform-based organizations. By showing how value propositions and business model features are linked in the sharing economy, the findings indicate the different legitimation strategies of grassroots initiatives and platform-based organizations, which we term “sustainability by model” and “sustainability by feature.” These findings broaden our understanding of the strategies that organizations apply to cope with societal expectations in the emerging sharing economy. According to Fleck, scientific concepts and practices are comparable with magic terms and ceremonies. This essay aims to identify the ethnological sources that Fleck’s epistemology is using. This article presents research on the scale of the phenomenon of sexual violence against students at selected 33 universities across Poland, the mechanisms used to combat the problem and the awareness of students on the subject. The study focuses on the practical dimension of combating sexual violence against students in the Polish academic environment. It looks at the existence and functioning of both specialised bodies and the procedures used to help the victims and punish the perpetrators. Additionally, the paper describes (...) how the diversity of available legal measures to address the problem by both helping the victims and holding perpetrators accountable creates the issue of the coexistence of two systems—criminal and intra-university. Presenting preliminary results of gathered opinions of universities’ officials regarding functioning of the bodies specialised in combating sexual violence shows not only the most dominant observations and conclusions the professionals have regarding the functions they hold at their home universities, but also main challenges that have to be considered in both creating sufficient policies in order to deal with sexual violence and conducting comprehensive research on said phenomenon. Researchers have theoretically proposed that humans decode other individuals' emotions or elementary cognitive appraisals from particular sets of facial action units (AUs). However, only a few empirical studies have systematically tested the relationships between the decoding of emotions/appraisals and sets of AUs, and the results are mixed. Furthermore, the previous studies relied on facial expressions of actors and no study used spontaneous and dynamic facial expressions in naturalistic settings. We investigated this issue using video recordings of facial expressions filmed unobtrusively (...) in a real-life emotional situation, specifically loss of luggage at an airport. The AUs observed in the videos were annotated using the Facial Action Coding System. Male participants ( n = 98) were asked to decode emotions (e.g., anger) and appraisals (e.g., suddenness) from facial expressions. We explored the relationships between the emotion/appraisal decoding and AUs using stepwise multiple regression analyses. The results revealed that all the rated emotions and appraisals were associated with sets of AUs. The profiles of regression equations showed AUs both consistent and inconsistent with those in theoretical proposals. The results suggest that (1) the decoding of emotions and appraisals in facial expressions is implemented by the perception of set of AUs, and (2) the profiles of such AU sets could be different from previous theories. Virtue ethics (VE), due to its eudaimonistic character, is very anthropocentric; thus the application of VE to environmental ethics (EE) seems to be in contradiction with EE’s critical opinion of human centeredness. In the paper, I prove the claim that there is a possibility of elaborating an environmental virtue ethics (EVE) that involves others (including nonhuman beings). I prove that claim through analyzing Ronald Sandler’s EVE, especially his concept of pluralistic virtue and a pluralistic approach to the aim of ethical (...) endeavor which is not only focused on personal flourishing but also helps others (including nonhumans) to flourish. I start my analysis with a close look at the application of anthropocentrism in VE, beginning by discerning the three types of anthropocentrism that are most often used in discussion on EE and EVE, namely ontological, epistemological, and ethical. Subsequently, I analyze the concept of personal flourishing, which is responsible for the anthropocentric/egoistic nature of VE, proving that VE is anthropocentric/egoistic only formally, not in its content, and as such is only a rational theory, not a moral one. The current issue considers the logical parameters of life and the living in their respective determinations in Kant and in Hegel. These two different approaches and philosophical methods are examined through the term „form“ and its respective conceptions in order to show, on the one hand, the immanent relation of life and form, which in turn refers elementarily to thinking and its systematic foundations − in Kant it is space and substance and in Hegel idea and objectivity − in order (...) to, on the other hand, reveal to what extent the handling of the „supersensory principle“ differs in the philosophy of Hegel and Kant, which is the condition for the determination of time and perseverance in both Kant and Hegel, which in turn affects the concepts of life and the living and their relation to form. This research focuses on the detection of interrelations between perfectionism and trait emotional intelligence in children of middle school age. The Frost multidimensional scale of perfectionism for the detection of the perfectionism level was used. The global level of trait emotional intelligence was measured with the trait emotional intelligence questionnaire for children. The research sample consisted of 120 middle school children between 10 to 12 years old. The sample comprised of 80 girls and 40 boys. The results of the research (...) failed to reveal any statistically significant relations between perfectionism and trait emotional intelligence. (shrink)

Since 1959, when C.P. Snow delivered his seminal lecture The Two Cultures on the lack of understanding between scholars working in the humanities and their colleagues from science departments, the gap between the two groups has been one of the most notorious clichés of contemporary Western culture. The aim of this article is to show that this seemingly insurmountable abyss between sciences and the humanities that was brought to the forefront during the mid-20th century is slowly receding into history. Literature (...) studies today is heavily indebted to modern science. Biology, physics, and ecology are among the most important subjects scholars of literature have to take into account. In order to prove this point I shortly describe literary genres which introduce modern science to the readers: science fiction, cyberpunk, solarpunk, lablit, quantum fiction, and cli-fi. I also refer to the newly-emerged schools of criticism-science fiction studies, ecocriticism and evocriticism-to show how scholars discuss these texts within the framework of the humanities. Additionally, I give a sample discussion of one of the cli-fi’s classics, J.G. Ballard’s The Drowned World and also shortly discuss two science fiction novels concerned with the civilisational conflict between science and humanities: Stanislaw Lem’s His Master’s Voice and Margaret Atwood’s Oryx and Crake. This article addresses the aesthetic status of gargoyles in medieval Gothic architecture. Irreducible to the grotesque yet manifestly discrepant with the core of cathedral and monastic buildings, the gargoyle serves as an entry point for an exploration of the stylistic relations comprising the Gothic and reflecting the cultural duality of the ecclesiastic sites of its historical emergence. The relation between gargoyles and the bulk of Gothic structures and ornamentation is discussed in terms of an “aesthetics of contrast.”.

This article begins from the assumption that what was once an integral dimension of progress—the development of literature and of art more generally—now lies outside its scope. The essay falls into three parts that juxtapose French with German intellectual history. The first part examines the notion of literary progress developed by Charles Perrault and Fontenelle, as well as the opposition to it by Boileau and other antiquarians, during the querelle des Anciens et des Modernes in the later seventeenth century. The (...) second part treats the reception of those arguments during the eighteenth century by J. C. Gottsched, J. J. Bodmer, and J. J. Breitinger. Special attention is given to the paradox that Gottsched, the leader of the German antiquarians, and Bodmer, the leader of the German progressives, were equally devoted to the Leibnizian-Wolffian philosophical system and thus that German Romanticism, heavily indebted to Bodmer's poetics, had roots in rationalist philosophy. The essay's third part discusses ideas of literary progress in the writings of the early Romantics J. G. Herder and Friedrich Schlegel. As these discussions show, the conception of general progress was formed in a field that has since dissociated itself from progress's march. (shrink)

The study focuses on the theoretical underpinnings of the ideological struggle in social processes as seen through the lens of the Argentinian philosopher Héctor P. Agosti's political philosophy. It discusses the impact of Agosti's interpretation of ideology in social struggle the usefulness of his conclusions for later practical developments in Latin America. The aim of the study is to describe the key aspects of Agosti's view of culture and ideology and to identify specific features of his approach with a view (...) to determining how and to what extent Agosti's political thought contributed to subsequent theories and practice. The following aspects are analysed: understanding culture as a contradictory process in dynamic social development, the role of the intellectual in the social struggle for ideological hegemony and specific features of Agosti's approach to developments in revolutionary thought in revolutionary thought in the Latin America. Presented research focuses on detecting of interrelationships between the overall rate of self-harm and the symptomatology of eating disorders. The research group consisted of 60 adolescent girls with eating disorders. We used the SHI questionnaire to determine self-harm and EDI-2 to determine the symptoms of individual eating disorders. We detected that there was a moderate positive relationship between self-harm and the overall score in EDI-2 symptoms. We also found moderate and weak positive relationships between eating disorders symptoms and self-harm. Mentalization is a process of social cognition that involves making inferences about one’s own behavior and the behavior of other people on the basis of unobservable mental states. Particularly in psychodynamic approaches, mentalization is conceptualized in the context of activation of internal representation of emotional relationship. In this study, we checked whether mentalization constitutes a predictor of relational satisfaction in the context of one’s own and the partner’s specific attachment. The research sample was composed of 32 heterosexual couples living together (...) for at least two years. Three tools were applied: the Mental State Task, Experiences in Close Relationships-Relationship Structures, and the Relationship Assessment Scale. The results indicate a strong negative effect of one’s own attachment anxiety and avoidance, and a strong effect of the partner’s attachment anxiety on the relationship satisfaction for both men and women. In women, the incremental validity of mentalization in predicting satisfaction in the relationship beyond the attachment of their partners has been observed. The results are discussed in the context of the intrapsychic and interpersonal aspects of mentalization and attachment. (shrink)

Precarity applies to people who, in order to survive, need to work in a low-quality job, which is uncertain, temporary, low-paid, with no prospect of promotion, no security and no contract. In this sense, the precariat is a category related mostly to the secondary segment of the labour market, according to the concept of a dual labour market. It is also the universal feature of Post-Fordism and the modern working conditions in which women, more often than men, are located in (...) the ‘worst’segment of the labour market. In this context, it can be noted that since the beginning of the era of globalization, women start working particularly in those sectors that were more uncertain and unstable e.g. in services and trade. It was feminization in a double sense: there were more and more working women on the one hand, and on the other hand, the flexible jobs were undertaken usually by women. Most of these kind of jobs were precarity jobs. Precarity is combined with insecurity, which does not allow the people in this group to plan anything, and wages so low that they can’t afford a decent life. In the article I would like to prove that the threat of precariat is more probable for women than men. I present data related to precarity for Poland compared to other European countries (based on data from Eurostat and the OECD). (shrink)

Within contemporary philosophy, practical consequences of agnosticism about the existence of God have mostly been discussed on the margins of other topics—such as the nature of faith or the problem of divine hiddenness. The aim of this article is to present the existing views on the practical upshots of suspending one's judgment on God's existence, briefly discussing the way in which agnosticism relates to practical atheism, non‐doxastic faith, fictionalism, apophaticism, and spiritual inquiry.

This article probes the usefulness of selected theories from Cognitive Linguistics in the context of statutory interpretation. The presumption of legal language is a well-established rule of statutory construction in Polish legal practice that comes from the internationally recognised theory by Jerzy Wróblewski. It rests on a controversial assumption that there are different levels of generality in legal language (i.e. the language of statutes) and a single term may be given different meanings depending on the level of generality that is (...) referred to. The authors use the notion of basic level categorisation from the cognitive theory of prototypes to explain this mechanism. Legal concepts, not unlike ordinary concepts, form hierarchical taxonomies. A single term may denote concepts that are situated at different levels in different conceptual taxonomies. In the absence of special circumstances, a legal term should be given the meaning that resides at a higher level of categorisation in the respective legal taxonomy. This way, the presumption of legal language is found to be justified on both linguistic and psychological grounds. (shrink)

The aim was to synthesize the findings of empirical research about the unmet nursing care needs of older people, mainly from their point of view, from all settings, focusing on (1) methodological approaches, (2) relevant concepts and terminology and (3) type, nature and ethical issues raised in the investigations. A scoping review after Arksey and O’Malley. Two electronic databases, MEDLINE/PubMed and CINAHL (from earliest to December 2019) were used. Systematic search protocol was developed using several terms for unmet care needs (...) and missed care. Using a three-step retrieval process, peer-reviewed, empirical studies concerning the unmet care needs of older people in care settings, published in English were included. An inductive content analysis was used to analyse the results of the included studies (n = 53). The most frequently used investigation method was the questionnaire survey seeking the opinions of older people, informal caregivers or healthcare professionals. The unmet care needs identified using the World Health Organization classification were categorized as physical, psychosocial and spiritual, and mostly described individuals’ experiences, though some discussed unmet care needs at an organizational level. The ethical issues raised related to the clinical prioritization of tasks associated with failing to carry out nursing care activities needed. The unmet care needs highlighted in this review are related to poor patient outcomes. The needs of institutionalized older patients remain under-diagnosed and thus, untreated. Negative care outcomes generate a range of serious practical issues for older people in care institutions, which, in turn, raises ethical issues that need to be addressed. Unmet care needs may lead to marginalization, discrimination and inequality in care and service delivery. Further studies are required about patients’ expectations when they are admitted to hospital settings, or training of nurses in terms of understanding the complex needs of older persons. (shrink)

In the 1960s, western societies discovered that unlimited technological progress has a very high price that the environment pays. This was also the beginning of the discussions on the role of ethics in the protection of the environment and the moral aspects of nature exploitation. Even though the state of nature was not better in Poland, it took Polish philosophers a few decades to recognize the moral problem and to address it. The prevailing communistic propaganda of progress had blurred the (...) perception of Polish people and they are unable to notice the environmental problem. Thus, only in the 1990s, after the fall of communism, Polish philosophers noticed that our approach to nature can have a moral aspect and we are exhausting the resources of the Earth. Since then, Environmental Ethics in Poland has been developed. Polish Environmental Ethics is an interesting blend of inspiration from internationally recognized thinkers as well as original approaches to the ecological problem. The first wave of PEE addresses problems discussed abroad, namely the range of ethics and the problem of values, analyzing them in the context of Polish culture and philosophical traditions. It also proposed original approaches developed by Henryk Skolimowski as well as approaches inspired by the problems considered from the perspective of Catholic theology. The article will give an insight into PEE and will present how these applied ethics have been received and cultivated in Poland in the so called first wave. It will also highlight the problems of the second wave of PEE. (shrink)

Atypical emotion interpretation has been widely reported in individuals with borderline personality disorder ; however, empirical studies reported mixed results so far. We suggest that discrepancies in observations of emotion interpretation by iBPD can be explained by biases related to their fear of rejection and abandonment, i.e., the three moral emotions of anger, disgust, and contempt. In this study, we hypothesized that iBPD would show a higher tendency to correctly interpret these three displays of social rejection and attribute more negative (...) valence. A total of 28 inpatient iBPDs and 28 healthy controls were asked to judge static and dynamic facial expressions in terms of emotions, valence, and self-reported arousal evoked by the observed faces. Our results partially confirmed our expectations. The iBPD correctly interpreted the three unambiguous moral emotions. Contempt, a complex emotion with a difficulty in recognizing facial expressions, was recognized better by iBPD than by healthy controls. All negative emotions were judged more negatively by iBPD than by controls, but no difference was observed in the neutral or positive emotion. Alexithymia and anxiety trait and state levels were controlled in all analyses. (shrink)

In teacher education, students have to link theoretical knowledge from educational studies or other academic fields with classroom experiences in formal settings such as triadic mentoring conversations. Students make this link through verbal activities, which are the heart of our analysis. Students produce complex discourses in which they position themselves, refer to multiple types of knowledge, describe and analyse their practicum. Considering that discourse analysis enlightens professional development processes, we study what prospective teachers (PTs) learn in a specific moment of (...) formal mentoring conversations that is a presentation of problematic issues. We compare the evolution of these presentations for two PTs. Through an utterer centred approach, we focus on three key elements: positioning adopted by PTs regarding the content of their sayings and their discussion partners; the way they integrate the theoretical concepts in their discourse; and the way they put in words working experiences and specific internship events. These elements enlighten the process of self-building and building of professional knowledge. Our results point out that in these « in between » settings, preservice teachers produce two kinds of discourse: academic and professional. (shrink)
